These Terms & Conditions ("Terms") govern the bus transportation payment facilitation service provided by NxtWave Disruptive Technologies Private Limited ("NxtWave") for Candidate ("Student"/"User"/You) enrolled in Academy On-Campus Program (“Program”) as part of its initiative NxtWave Institute of Advanced Technologies (“NIAT”). By making a payment for bus transportation services on this platform, you agree to these Terms.

For Students below the age of 18 years ("Minors"), the terms "Student," "User," or "You" shall be deemed to include the parent(s) or legal guardian(s) of the Minor. All obligations and responsibilities outlined in these Terms & Conditions for the Minor shall be assumed and undertaken by the parent(s) or legal guardian(s). By agreeing to these Terms, the Minor confirms that explicit consent has been obtained from their parent or legal guardian to use the transportation payment facilitation service.

1. Scope of Service

1.1 Facilitation of Transportation Services

• NxtWave has collaborated with a third-party bus service provider ("Service Provider") to offer transportation services exclusively for day scholar students attending Academy On-Campus Program at NIAT.

• NxtWave’s role in this arrangement is strictly limited to facilitating the payment process. NxtWave does not provide or manage the transportation services directly. The actual transportation services, including but not limited route planning, scheduling, vehicle maintenance, and driver management, are solely the responsibility of the Service Provider.

1.2 Collection of transportation Fees

• Students who wish to avail of the bus transportation service are required to pay the transportation fee including applicable taxes for the entire semester upfront via the designated payment portal on the NxtWave website.

• This payment will cover the cost of transportation including applicable taxes for the specified semester and must be made in full before the student can access the transportation services.

1.3 No Involvement in Service Quality

• NxtWave’s role is strictly financial facilitation. NxtWave does not monitor, control, or influence the quality of the transportation services provided by the Service Provider. This includes but is not limited to the condition of the buses, punctuality, route management, driver conduct, and overall service delivery

• NxtWave does not assume any responsibility for the operational aspects of the transportation service.

1.4 Direct Relationship with Service Provider:

• Any issues, concerns, or disputes related to the transportation service must be addressed directly with the Service Provider. This includes but is not limited to matters related to service quality, delays, accidents, or any other incidents that occur while using the transportation service.

• NxtWave will not mediate disputes or provide compensation for any dissatisfaction related to the transportation services.

2. Student Obligations

• By making the transportation fee payment including applicable charges, students acknowledge and agree that their relationship with NxtWave in this context is limited to payment facilitation. The primary service relationship regarding transportation lies between the student and the Service Provider.

• It is the responsibility of the students to stay informed about the transportation schedule, rules, and guidelines as provided by the Service Provider.

3. Refunds or Adjustments

• Once the payment is made, it is non-refundable under any circumstance.

• Users should carefully review the service terms and conditions before making the payment.

• NxtWave is not liable for any financial discrepancies, issues, or disputes arising from the transportation fee payment. Any such matters must be directly addressed with the Service Provider.

• NxtWave’s responsibility ends with the successful processing of the payment to the Service Provider. Any subsequent issues, including service quality or operational disruptions, are outside NxtWave’s financial liability.

4. Limitation of Liability

• NxtWave’s involvement is solely as a payment facilitator NxtWave is not responsible for the quality of the transportation services provided by the Service Provider.

• NxtWave will not be liable for any incidents, delays, or any other issues that may occur during the transportation of students.

• NxtWave will not be liable for any interruptions or suspensions of the transportation service, whether due to operational issues, legal constraints, accidents, incidents or other unforeseen circumstances affecting the Student or Service Provider.

• In the event of service interruptions, NxtWave is not responsible for providing alternative transportation or compensating students for any inconvenience or loss.

• Any disputes or issues related to the transportation services must be directly addressed with the Service Provider.

• NxtWave is not liable for any accidents, injuries, damages, insurances, losses, or any other incidents that may occur while students are using the bus transportation service. The responsibility for such incidents lies solely with the Student and Service Provider.

• Students and their guardians are advised to directly address any safety concerns or incidents with the Service Provider.

5. Timelines for Payment

• Students are required to complete the payment for bus transportation services by the specified deadline provided by NxtWave. Failure to meet this deadline may result in the student being ineligible to use the transportation services for the upcoming semester.

• Payments made after the specified deadline may be subject to additional late fees as determined by NxtWave. Students who fail to make the payment within the grace period (if any) provided may be denied access to the transportation services until full payment is made, including any applicable late fees.

6. Handling of Complaints and Disputes

• In the event of any dispute, complaint, or issue arising from the transportation services, including but not limited to service quality, delays, accidents, or any other incidents, the student must raise the complaint directly with the Service Provider. NxtWave is not responsible for mediating or resolving such disputes.

• Students are encouraged to keep the contact details of the Service Provider handy for promptly addressing any issues or concerns that may arise during the course of using the transportation service.

7. Amendments to Terms

• NxtWave reserves the right to modify or amend these Terms at any time. Any changes will be communicated to the students via email or through the NxtWave website. Continued use of the payment facilitation service following any amendments signifies acceptance of the revised Terms.

• Students are responsible for regularly reviewing these Terms to stay informed of any changes. NxtWave will provide a notice of significant changes once they take effect.

8. Termination of Service

• NxtWave reserves the right to terminate or suspend access to the payment facilitation service at any time, without notice, if the student violates these Terms or engages in fraudulent or unlawful activity or for any other reason.

9. Indemnification

• By using the payment facilitation service, students and their guardians agree to indemnify and hold NxtWave harmless from any claims, demands, or legal actions arising out of or related to the use of the transportation service.
  This indemnification extends to any costs, damages, or expenses, including legal fees, incurred by as a result of such claims.

10. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Telangana, India.

11. Acceptance of Terms

• By proceeding with the payment, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
