Overview

By enrolling in the Academy On-Campus Program, the student and their parents/legal guardians acknowledge that they have thoroughly read and understood the Student Code of Conduct and that they shall abide by it.

Enrollment/continued enrollment in the Program is a deemed acceptance of the Code of Conduct, and its updated versions.

1. Preface

At NxtWave Institute of Advanced Technologies ("NIAT"), an initiative of NxtWave Disruptive Technologies Pvt Ltd ("NxtWave" or "Company"), we are deeply committed to fostering a community grounded in collaborative learning, respect, honesty, and integrity. Our Code of Conduct serves as a guiding beacon, illuminating the path of acceptable behavior and drawing a clear line against actions that deviate from our cherished values. We believe that the essence of education extends beyond the confines of classrooms and digital platforms; it is reflected in the character and actions of our students.

NIAT offers specialized training through its four-year on-campus upskilling program, Academy On-Campus ("Program"). This Program of NxtWave is tailored for students who have completed their secondary education (12th grade or equivalent) and aim to meet the industry's IT/ITES domain requirements. Enrollment/continued enrollment into the Program constitutes a deemed acceptance of the Code of Conduct and its updated versions, by the student and/or their parent/legal guardian.

Every student enrolled in the Program is our ambassador, carrying the weight of our legacy and reputation. As such, we expect our students to uphold the highest standards of responsibility and decorum, both within the premises and beyond its gates.

We recognize that the world outside is an extension of our NIAT community. Therefore, ensuring adherence to our code of conduct is not limited by geographical boundaries. We remain vigilant and proactive, taking cognizance of any act of misconduct committed by a student, irrespective of where they occur, including digital spaces. Our commitment is unwavering: to ensure that our spirit of respect and responsibility resonates in every corner of the world where our students set foot.

Enrollment to the Program carries with it the presumption that students will conduct themselves as responsible members of the community. They should refrain from any conduct that would interfere with Program functions or endanger the health, welfare, or safety of other persons.

Non-Discrimination Requirement

Students should not discriminate on the basis of race, color, creed, age, religion, gender, national or ethnic origin, marital status, sexual preference, physical disability, or any other legally protected status. They should at all times conduct themselves in a manner, which is not prejudicial to any law of the land.

4. General Guidelines

4.1 Commitment to Completion

Students must demonstrate dedication and regularity in their Program pursuits. It is imperative that each student completes their studies within the stipulated tenure set by NxtWave.

4.2 Upholding Program Integrity

At the heart of NxtWave ethos is Program integrity. Students must uphold the highest standards of Program integrity which includes honesty in examinations, assignments, and any other Program work. Cheating, Plagiarism, fabrication, and falsification of information are strictly prohibited.

4.3 Protecting Program's Reputation

Our students are the face of NxtWave and/or NIAT. It is essential that they abstain from any form of misconduct both on and off the premises, as well as on any online platform. Engaging in activities that could tarnish NxtWave and/or NIAT's interests and reputation.

4.4 Attendance

Regular attendance to classes, sessions, workshops, training, and events is mandatory. Prior written approval has to be obtained for any absences. Unapproved absences may result in disciplinary action including but not limited to suspension, expulsion, and penalties. NxtWave reserves the right to deny its certification and placement support to students who do not meet attendance and participation standards.

Students who require medical leave due to health emergencies must provide appropriate medical documentation. NxtWave will review and accommodate such requests in accordance with its established policies and procedures.

4.5 Adherence to Timings

Punctuality is valued at NIAT. Students must strictly adhere to the timings set forth by Nxtwave and/or NIAT, subject to periodic updates. Non-compliance will attract stringent actions.

4.6 Dress Code

Students are expected to dress appropriately and modestly. Attire that is disruptive, provocative, or inappropriate for a formal setting is not permitted. The attire should be smart casual, devoid of any inappropriate or offensive slogans, disrespectful language or imagery, or references to drugs, tobacco, or alcohol. Ripped or torn clothing is not acceptable. Violators of the dress code will face immediate strict disciplinary actions.

4.7 Identity Card

Students must wear their ID cards, attached to the provided lanyard, ensuring it remains visible at all times. This is a non-negotiable aspect of NIAT decorum.

Respectful and appropriate language must be used at all times. Profanity, abusive language, or discriminatory remarks are not tolerated and will result in disciplinary action.

4.9 Health and Safety

Students must adhere to health and safety guidelines, including maintaining adequate health insurance, using medical and first aid resources responsibly, and complying with premises health regulations.

4.10 Media Activity

Students must obtain prior written approval before engaging in any media activities, whether online or offline, that involve NxtWave and/or NIAT including its employees and trainers. Unauthorized media activities will be subject to disciplinary action.

NxtWave places paramount importance on intellectual, and ethical integrity. We believe that the foundation of true learning and innovation is built upon these principles. NIAT is committed to recognizing and duly acknowledging every contribution, ensuring that the spirit of academic excellence is preserved.

Every individual associated with NxtWave, be it employees or students, carries the duty and responsibility of upholding the highest standards of Program integrity. Any deviation from these standards will lead to Program misconduct.

Violations of Program Integrity

While the following list outlines some of the primary violations of Program integrity, it is by no means exhaustive. NxtWave reserves the right to identify and address any other actions that compromise our commitment to Program integrity:

The use of unfair means is strictly prohibited and includes:

Plagiarism includes presenting someone else's work or ideas as one's own without proper acknowledgment. This applies to all assignments, papers, projects, and any other Program work. Proper citation must be given when using another person's work or ideas.

5.3 Misrepresentation of Information

Deliberately providing false or misleading information. This includes any intentional misrepresentation or falsification of details in assignments, assessments, or communications related to the Program.

5.4 Unauthorized Collaboration

Engaging in joint efforts without permission in any Program activity. This includes collaborating with others on assignments, assessments, or any other Program-related tasks without explicit authorization.

5.5 Unauthorized Sharing of Content

Distributing any NxtWave content, including study or test materials, or sharing login credentials and details through any medium.

5.6 Misrepresentation of Attendance

Responding on behalf of another student during official roll calls.

5.7 Compromising Evaluation Integrity

Sharing solutions to assignments, test materials, quizzes, or any other evaluations, or employing unfair means to complete them.

6. Acts Constituting Misconduct

At NxtWave, we strive to maintain an environment that fosters respect, integrity, and Program excellence. Any student found in violation of our Code of Conduct will be subject to appropriate disciplinary actions as outlined in the provisions of this Code. This clause outlines behaviors and actions considered as misconduct, whether they occur on or off the premises of NIAT or online.

Prohibited Acts

The following list of acts constituting Misconduct while not exhaustive, provides specific examples of actions deemed as misconduct and shall be strictly prohibited:

6.1 Defiance and Instigation

Willful insubordination, disobedience, or encouraging such behavior against any lawful and reasonable directive given by a teacher, mentor, guide, employees of NxtWave and any other people associated with Program/NIAT and any other people associated with Program/NIAT.

6.2 Illegal Strikes

Participating in or promoting unauthorized strikes or activities that disrupt the Program environment.

6.3 Theft and Fraud

Engaging in theft, fraud, or dishonest actions concerning NxtWave's property or that of other students, teachers, mentors, guides, or employees of NxtWave and any other people associated with Program/NIAT.

6.4 Bribery

Offering bribes or any illegal gratifications to any teacher, mentor, guide, or employees of NxtWave and any other people associated with Program/NIAT.

6.5 Unauthorized Absence

Habitually missing classroom or lab sessions without prior permission.

6.6 Improper Behavior

Engaging in drunken, riotous, disorderly, rude or indecent behavior, using abusive language, or threatening or interfering with other students, teachers, mentors, guides, employees of NxtWave, and any other people associated with Program/NIAT.

6.7 Negligence

Habitually neglecting instructions or failing to fulfill responsibilities given by any teacher, mentor, guide, employee of NxtWave, and any other people associated with Program/NIAT.

6.8 Property Damage

Causing damage, whether intentional or due to negligence, to any property of NxtWave or within the campus or accommodation.

6.9 Defamation

Making false or malicious statements or posting derogatory comments online against NxtWave and/or NIAT, its students, its teachers, its mentors or any member, or employee of NxtWave and any other people associated with Program/NIAT.

6.10 Physical Fights

Engaging in physical fights or any form of violence.

6.11 Medical Non-compliance

Refusing to undergo a medical examination when mandated by NxtWave.

6.12 Unauthorized Recording

Recording, distributing, and alteration of audio or video lectures, actions of students, teachers, mentors, guides, or employees of NxtWave and any other people associated with Program/NIAT.

6.13 Possession, Consumption, Distribution, Sale of Drugs, Alcohol/Alcoholic Beverages and/or Tobacco

Possession, Consumption, distribution, sale of drugs, alcohol or alcoholic beverages, cigarettes and or tobacco and its constituents.

6.14 Prohibition of Illicit Content

Watching, distributing, or possessing illicit content, including pornography.

6.15 Harassment

Engaging in any form of harassment towards NxtWave's students, teachers, mentors, guides, employees, or any other third parties. This includes verbal, physical, and online harassment.

6.16 Disruptive Conduct

Disruptive Conduct includes conduct that intentionally or unintentionally, substantially obstructs or disrupts regular activities including but not limited to teaching, freedom of movement, conducting workshops/seminars/conventions/student gatherings/functions.

6.17 Public Display of Affection

Engaging in public displays of affection (PDA) on the premises of NxtWave/NIAT, including but not limited to kissing, hugging, and other forms of intimate physical contact. Students are expected to maintain decorum and professionalism at all times within the campus environment. Any violations of this policy will result in immediate disciplinary actions as deemed appropriate by the administration.

6.18 Arms and Ammunition

The possession, use, or distribution of arms and ammunition.

6.19 Anti-National Activities

Engaging in anti-national, anti-communal, and terrorist activities.

6.20 Code Violations

Repeated breaches or deliberate violations of any Code of Conduct, guidelines, or rules applicable to the Program.

7. Anti-Discrimination Policy

Discrimination means engaging in verbal or physical behavior directed at an individual or group based on origin, race, creed, gender, religious beliefs, or sexual orientation that, according to a person of reasonable sensibilities, is likely to create an intimidating or demeaning environment. Such behavior impedes the access of other students, teachers, mentors, guides, employees of NxtWave and any other persons associated with NIAT/Program to any benefits available to them.

This also includes wearing articles of clothing with derogatory, racist, discriminatory, patently offensive, profane, sexually explicit, or graphic messages, whether in words or pictures, which demonstrate bias or discrimination against any individual or group within the Program.

Discrimination against any student, teacher, mentor, guide, or employee of NxtWave and any other persons associated with NIAT/Program in any form is strictly prohibited.

8. Anti-Ragging Policy

NxtWave is committed to providing a safe, supportive, and respectful environment for all students. Ragging, harassment, or any form of bullying will not be tolerated under any circumstances and is strictly prohibited.

Harassment encompasses unwelcome behavior of any kind that creates an intimidating, hostile, or offensive environment. This includes, but is not limited to:

Reporting Procedure

Students who experience or witness ragging or harassment are encouraged to report the incident immediately to the designated authority. Reports can be made in person or in writing. NxtWave will take all reports seriously and will investigate promptly and impartially.

Upon receiving a report of ragging or harassment, NxtWave will conduct a thorough investigation to determine the facts. If the investigation finds that a student has engaged in prohibited conduct, appropriate disciplinary and legal action will be taken. This may include suspension, expulsion, or other actions deemed necessary to ensure the safety and well-being of the community.

9. Sexual Harassment Policy

NxtWave is dedicated to maintaining a learning and working environment free from sexual harassment. Sexual harassment in any form is strictly prohibited and will not be tolerated. This includes unwelcome sexual advances, requests for sexual favors, and other verbal, non-verbal, or physical conduct of a sexual nature.

POSH Act Compliance

The Program is committed to providing a safe environment and addressing any incidents of sexual harassment in accordance with the Prevention of Sexual Harassment (POSH) Act. Appropriate measures, including legal and disciplinary action, will be taken against offenders.

POCSO Act Compliance

Any act of sexual harassment or abuse against minors, whether physical or verbal, will be addressed under the Protection of Children from Sexual Offenses (POCSO) Act. Such offenses will be reported to the appropriate authorities and will result in severe legal and disciplinary actions.

Investigation and Action

Upon receiving a report of sexual harassment, NxtWave will conduct a thorough investigation to determine the facts. If the investigation finds that a student has engaged in prohibited conduct, appropriate legal and disciplinary action will be taken. This may include suspension, expulsion, or other actions deemed necessary to ensure the safety and well-being of the community.

10. Drug-Free Premises Policy

NxtWave strongly advocates for drug-free premises and has zero tolerance towards any such practices. It is the strict policy of NxtWave that no student shall possess, use, distribute, or sell illegal drugs, controlled substances, or e-cigarettes on its premises or outside its premises. Possession of paraphernalia associated with the illegal distribution, sale, use, possession, or manufacture of controlled substances or electronic cigarettes is also strictly prohibited.

Student Responsibility

If a banned substance is found on a student's person or personal belongings, it is incumbent on the student to prove that the substance is not theirs. Students having knowledge of this misconduct must report it to the authorities of NxtWave immediately. Failure to report despite having knowledge of such misconduct will also be considered a misconduct of this policy.

Consequences

Legal action and strict disciplinary actions, including expulsion and penalties, will be imposed on any student found performing misconduct under this policy.

11. Disciplinary Actions and Punishments

NxtWave is committed to maintaining a safe, respectful, and productive environment for all students and members of its community. Violations of this Code of Conduct and any other instructions, policies, rules, or regulations of NxtWave will result in disciplinary actions and appropriate punishments to address and correct the behavior.

Range of Disciplinary Actions

NxtWave may impose a range of disciplinary actions based on the severity and nature of the violation and misconduct. These actions include but are not limited to:

Other Sanctions Any other appropriate measures deemed necessary
Community Service Mandatory community service as a corrective measure
Certificates Withholding and cancellation of certification

NxtWave reserves the right to take any legal action against individuals who directly or indirectly engage in misconduct, regardless of where, when, and with whom the behavior occurs.

Investigation Process

NxtWave will conduct a thorough and impartial investigation to determine the facts and circumstances of the reported misconduct. Based on the findings of the investigation, NxtWave will determine the appropriate disciplinary action. The individual involved will be informed of the decision and given an opportunity to respond.

13. Amendments to the Code

NxtWave retains the right to make amendments to any provision in this Code of Conduct. It is imperative for every student to familiarize themselves with and adhere to these guidelines. Non-compliance will be met with appropriate disciplinary actions, reinforcing NxtWave's commitment to upholding the highest standards of conduct and ethics. Continued enrollment in the Program shall be considered as deemed acceptance to the updated Code of Conduct.
